General conditions for the purchase of products on www.3vwallcoverings.com
3V Wallcoverings Srls invites each user to carefully read these general conditions of sale ( “General Conditions” ) of the products offered from time to time through the Site (as below defined) www.3vwallcoverings.com , before completing any purchase and, once this operation is completed, to print or save a copy in digital format.

1) Ownership of the Site – Applicable Law – Rules on purchases through the Site.

1.1. Without prejudice to the applicability, for what is not regulated and/or waived here, of Legislative Decree 6 September 2006 n. 205 on distance selling to consumers and Legislative Decree 9 April 2003 n. 70 in matters of electronic commerce, the General Conditions govern the remote purchase of the products and services promoted on the site www.3vwallcoverings.com ( “Site”; the products promoted from time to time on the “Products” Site ), of which 3V Wallcoverings Srls , with registered office in  Via S. D’Acquisto, 16 – 71045 Orta Nova (FG) – Italy , VAT number  04425920719 is the owner, by the user of the Site ( “Customer” ).

1.2. The Products distributed by 3V Wallcoverings Srls through its Website consist, by way of example but not limited to, of customized wallpapers. The customer undertakes to verify the correctness of the dimensions of the wall indicated at the time of the order. All the Products made available to Customers are illustrated on the homepage of the Site and/or within the various web pages of the same and of the Shop.

1.3. The terms and methods for the purchase of Products offered by 3V Wallcoverings Srls through the Site are contained in these General Conditions, supplemented, where the characteristics of the Product offered make it necessary, by specific provisions and technical instructions indicated from time to time on the Site itself in the product sheet. The General Conditions are an integral part of the contract for the sale of the Products concluded between the Customer and 3V Wallcoverings Srls

1.4. The offer of 3V Wallcoverings Srls products is aimed at consumer customers.

1.5. 3V Wallcoverings Srls may modify the General Conditions without notice. These changes will take effect from the date of their publication on the Site: however, the General Conditions in force at the time of conclusion of the sales contract will be applied to the purchase orders sent to 3V Wallcoverings Srls before the publication of the aforementioned changes.

2) Purchase procedure – Conclusion of the Sale Contract

2.1. The visual representation of the Products on the Site, where available, corresponds to the photographic reproduction of the same and has the purpose of presenting them for sale, without this implying any guarantee obligation or explicit or implicit commitment by 3V Wallcoverings Srls regarding the exact correspondence of the image depicted on the Site with the Product, with particular reference – in relation to the Products – to the chromatic aspects of the covers and/or packaging and to the scenario represented.

2.2. The publication of Products on the Site constitutes an invitation to users to formulate a purchase proposal to 3V Wallcoverings Srls.

2.3. If a specific Product should be presented on the Site in an area other than those intended for purchase operations or, in any case, it should not be possible to select the “Add to Cart” icon, it must be understood as available for sale for which it will be possible directly contact 3V Wallcoverings Srls using the appropriate form.

2.4. Each order sent by the Customer to 3V Wallcoverings Srls has the value of a contractual proposal and can be formulated by filling in the appropriate online form, complete with all the data requested therein and marked as mandatory (“Order” ) .

2.5. Where the Customer fails to fill in any of the Order fields marked as mandatory, the system will not allow the Order to be sent to 3V Wallcoverings Srls: only after the Order has been correctly filled in with all the requested data, the Customer will be authorized to send the Order.

2.6. In any case, the Customer undertakes to communicate correct, updated and truthful data relating to personal data, personal address and in general to other information useful for fulfilling the order.

2.7. Once the Order form has been completed, by clicking on the “Add to Cart” icon, the Customer will be asked to read and accept the General Conditions and the Privacy Policy: in the absence of this reading and acceptance, the Order cannot be forwarded. At the end of this acceptance operation, the Order will be automatically forwarded to 3V Wallcoverings Srls

2.8. Once the Order has been received, 3V Wallcoverings Srls will automatically send the Customer, to the e-mail address indicated by the same in the Order (hereinafter “Email Address” ), an e-mail confirming receipt of the Order itself (hereinafter ” Confirmation of Receipt” ), containing the details of the Order, all the data relating to the purchase, the summary of the requested Products and the relative costs, a summary of the personal data, the Customer’s contact details, the address indicated by the Customer as the place of delivery of the Product ordered (hereinafter “Place of Delivery”), as well as the links through which the Customer can check the status of the Order. The Customer undertakes to verify the correctness of the data contained in the Order and summarized in the Confirmation of Receipt and to promptly notify 3V Wallcoverings Srls3V Wallcoverings Srls of any changes that need to be made to the aforementioned data.

2.9. It is understood that the Confirmation of Receipt does not constitute acceptance of the contractual proposal formulated by the Customer with the Order, but simply a confirmation of receipt of the Order by the system.

2.10. 3V Wallcoverings Srls has the right not to accept the Orders received, without the Customer being able to advance rights or claims against 3V Wallcoverings Srls for any reason. In the event of non-acceptance of the Order by 3V Wallcoverings Srls, the latter will promptly return to the Customer any amount already paid by the latter for the purpose of fulfilling the Order. For the purposes referred to in this art. 2.10, it is in any case understood that in the event that the Customer, when formulating the Order, had chosen cash on delivery as the payment method (payment method currently not permitted) no refund will be due by 3V Wallcoverings Srls to the Customer .

2.11. The sales contract will be considered concluded (i) upon acceptance of the Order by 3V Wallcoverings Srls sent to the e-mail address indicated by the Customer in the same Order or (ii) tacitly, if 48 hours have elapsed from receipt of the Order by 3V Wallcoverings Srls as resulting from the Confirmation of Receipt, in the event that the same 3V Wallcoverings Srls does not send the Customer, to the e-mail address indicated by the same in the Order, communication of non-acceptance of the Order (hereinafter “Sales Contract” ).

2.12. Upon receipt of acceptance of the Order by 3V Wallcoverings Srls or once 48 hours have elapsed from receipt of the Order by 3V Wallcoverings Srls without the latter having communicated its non-acceptance, the same 3V Wallcoverings Srls will to carry out the operations necessary for the shipment of the Products selected by the Customer: specific notification will be given to the Customer of this shipment by email sent to the email address communicated by the Customer with the Order.

2.13. The purchase of the Products is reserved for persons of legal age or who in any case have the capacity to act: moreover, the purchase may be made by a minor as long as it is made or in any case authorized by whoever exercises parental authority. 3V Wallcoverings Srls declines all responsibility in the event that incapable persons act in violation of this rule.

2.14. The status of each Order can be viewed by the Customer on the Site in the “My Orders” section, which the Customer can access through the links in the acceptance e-mail from 3V Wallcoverings Srls or in any case by clicking on the appropriate icon at the bottom of each web page of the Site, by entering the authentication credentials chosen at the time of the Order.

2.15. Each Contract of Sale will be filed by 3V Wallcoverings Srls through an electronic system and can be viewed, where necessary, both by the staff of 3V Wallcoverings Srls and by any third parties it uses for the execution of the Contract of Sale.
2.16. The chosen product will be printed according to the measurements provided by the customer, taking the center of the image as a reference, proportioning and developing the cut to the measurements indicated so as not to alter the proportions of the printed image.

3) Price of the Products

3.1. The prices of the Products published on the homepage or in the various sections of the Site dedicated to each individual Product are inclusive of VAT and do not include any taxes and/or duties.

3.2. The total price of the Order will include, where applicable, in addition to the amounts referred to in the previous art. 3.1., also the cost of shipping.

3.4. The total amount due for the selected Products will be clearly indicated and communicated to the Customer, before the conclusion of the process of formulation of the Order, and, therefore, before the completion of the Contract of Sale.

4) Methods of payment

4.1. Payments in execution of the Sales Contracts can be made online through the Stripe Payment Gateway (and the main credit cards of the circuit) or by bank transfer .

4.2. 3V Wallcoverings Srls reserves the right to authorize the use of additional payment methods at the specific request of the Customer: it is understood that, as a derogation from the provisions of these General Conditions, the authorization granted by 3V Wallcoverings Srls to the Customer to use a different method of payment will constitute a Special Condition applicable exclusively to the payment of the purchase referred to in the Order to which this concession refers.

4.3. When placing the Order, the Customer is required to expressly indicate the payment method chosen from the available options.

4.4. 3V Wallcoverings Srls reserves the right to verify, at any time, the ownership of the payment instrument used or the possession of the requirements to purchase the Products from the Site (see, for example, the provisions of the previous Condition 2.13): this, by requesting the Customer sending supplementary information and/or documents. If the Customer does not comply with the requests of 3V Wallcoverings Srls, the latter will have the right not to accept the Order, or to withdraw from the Contract of Sale already completed, by promptly notifying the Customer via the Email Address.

4.5. Payment through Stripe will take place by redirecting to the Stripe.com website, where the procedures for transferring the sums due to 3V Wallcoverings Srls can be completed. The Customer’s financial data will be managed directly by Stripe and will not be shared with 3V Wallcoverings Srls

4.6. Payment for the Products by cash on delivery is not permitted at this time.

4.7. In the event of non-payment – for whatever reason – of the price indicated in the Sales Contract, 3V Wallcoverings Srls reserves the right to terminate the Sales Contracts in place with the Customer due to breach by the Customer, with immediate effect, as well as to block the purchase functions assigned to the Customer by giving immediate written notice to the Customer, without prejudice to the right of 3V Wallcoverings Srls to request compensation for any further damage suffered.

4.8. The Customer will receive a regular invoice / tax receipt.

5) Delivery times of the products

5.1. Expected delivery times are within 2 weeks in Italy. Availability and delivery times may vary with respect to what is reported both for shipments abroad and for a large number of orders reached simultaneously on the same day.

5.2. 3V Wallcoverings Srls is not responsible for any delays occurring during the transport service and, therefore, does not undertake or guarantee full compliance with the delivery times indicated on the Website and/or in the Order.

5.3. 3V Wallcoverings Srls invites the Customer to periodically check the status of the Order in the “My Orders” section of the Site as well as to contact the Customer Assistance Service: in this section the status of the Order will also be indicated pursuant to articles 5.8. and the following.

5.4. All shipments of the Products will be at the risk of 3V Wallcoverings Srls which guarantees compliance with the quality standards relating to the Products and Services exclusively up to the time of the first delivery attempt at the Delivery Location referred to in the following art. 5.7.

5.5. For each Contract of Sale finalized through the Website, 3V Wallcoverings Srls will issue a delivery note, a copy of which will be sent to the Customer’s Email Address: this document, once sent to the Customer, can no longer be modified.

5.6. For the purposes of delivery of the Products ordered by the Customer, the presence of the Customer or of the third party recipient indicated by the Customer or their appointee is always required: if none of these parties is available and in the Delivery Location at the time of delivery (hereinafter ” First Delivery Attempt” ), the courier will leave a notice for a second delivery for the following working day, as well as a telephone number in order to agree on a different date and a different delivery time, as well as, possibly, a different Delivery Location (of hereinafter “Second Delivery Attempt” ).

5.7. If the Customer or the third recipient indicated by the latter or a person in charge of the latter should not be available even on the Second Delivery Attempt, the Product will be held in storage by the courier for a maximum period of 15 days starting from the Second Delivery Attempt (hereinafter “Storage Term” ).

5.8. In the case provided by the previous art. 5.7., the Customer can contact 3V Wallcoverings Srls Customer Assistance who will inform him of the courier’s office where the Product can be collected: the Customer must go to the indicated office with the “delivery notice” left by the courier. There will be no additional cost for Storage.

5.9. Once the Term of Storage has elapsed without the Customer or the third recipient indicated by the latter or their representative having collected the Product in accordance with the provisions of articles 5.6. and 5.7., the Product will return to the warehouses of 3V Wallcoverings Srls: in this case the Customer, within and no later than 30 days from the expiry of the Storage Term, may request from 3V Wallcoverings Srls, alternatively:

– 5.9.1. a second shipment of the Product (hereinafter “Second Shipment” ) to which the provisions of articles will apply 5.1 and following of these General Conditions, which 3V Wallcoverings Srls will be able to implement only against the prior payment by the Customer of the price of the Second Shipment. Furthermore, even if said shipment is not successful, the Sales Contract will be automatically terminated due to non-fulfilment by the Customer and 3V Wallcoverings Srls will be authorized to withhold the amount of the Order as compensation for the damages suffered by the same.
– 5.9.2. reimbursement of the amount paid for the Order: it being understood that 3V Wallcoverings Srls will have the right to withhold from the amount paid by the Customer all costs incurred by the same for the first shipment, including any Fee for the Stock, as well as the any duties and taxes; it is also understood that the right of reimbursement referred to in this art. 5.9.2 is excluded in the event that the Customer at the time of the Order has chosen cash on delivery as the means of payment (payment method currently not permitted).

5.10. 3V Wallcoverings Srls reserves the right to terminate the Contract of Sale or to split, postpone or cancel, in whole or in part, the expected delivery in cases of force majeure, unavailability of means of transport, unpredictable events, if said events cause a excessive delay in deliveries or make them difficult or impossible and/or cause a significant increase in the relative cost to be borne by 3V Wallcoverings Srls: in such cases, 3V Wallcoverings Srls will promptly send notice to the Customer’s Email Address, who will be entitled to obtain the refund of any price paid, with the exclusion of any further claim or compensation, for any reason, against 3V Wallcoverings Srls.

6) Customer’s Right of Withdrawal – Withdrawal of 3v wallcoverings srls

The nature of the products sold by 3V Wallcoverings, being customized wallpapers , specially made and printed with the wall measurements indicated by the customer, does not provide for the right of withdrawal ( pursuant to article 64 section c. of the Code of consumption ). Therefore the customer undertakes to verify the correctness of the dimensions of the wall indicated at the time of the order and before forwarding it. No refund or cancellation of the order will be provided in the event that the customer has indicated the wrong measurements in the order form. Below are the regulatory references referred to above.

6.1. The right of withdrawal provided for in articles 64 and following, as well as articles 52 and 53 and paragraph 1 of article 54 do not apply :
a) to contracts for the supply of foodstuffs, drinks or other goods for domestic consumption electricity supplied to the consumer’s home, place of residence or place of work, by distributors who make frequent and regular rounds;
b) to contracts for the supply of services relating to accommodation, transport, catering, leisure, when, upon conclusion of the contract, the professional undertakes to provide such services on a specific date or in a pre-established period.
2. Unless otherwise agreed between the parties, the consumer cannot exercise the right of withdrawal provided for in articles 64 and following in the cases:
a) supply of services whose execution has begun, with the consumer’s agreement, before the expiry of the term established by article 64, paragraph 1;
b) the supply of goods or services whose price is linked to fluctuations in financial market rates that the professional is unable to control;
c) the supply of goods made to measure or clearly personalized or which, by their nature, cannot be returned or are likely to deteriorate or expire rapidly;

6.2. 3V Wallcoverings Srls has the right to withdraw from each Contract of Sale entered into by any Customer, by giving written communication to the same by registered letter with return receipt; likewise, 3V Wallcoverings Srls may not accept any Order from Customers who have engaged in irregular behaviour, have not accepted the Products purchased on delivery (payment method currently not permitted), are suspected of conduct contrary to the law or case in which the non-acceptance is imposed by an order from a judicial authority.

7) Warranty – Returns

7.1. If the Products enjoy a conventional guarantee recognized by the manufacturer, any faults, defects or discrepancies must be reported directly to the manufacturer as indicated on the Product packaging or in the illustrative brochure.

7.2. Unless required by law, 3V Wallcoverings Srls declares that it has no responsibility for faults, defects or non-conformities of the product. The guarantee for the Consumer pursuant to Legislative Decree 206/2005 remains unaffected.

7.3. In this case, the Consumer must, under penalty of forfeiture, report the defect found to the 3V Wallcoverings Srls Customer Assistance Service using the procedures set out in the previous art. 6.2. within the term of 2 (two) months from the date of discovery of the defect.

7.4. 3V Wallcoverings Srls will make every reasonable effort to replace and ensure that the manufacturer and/or supplier replaces the defective product at its own expense and within a reasonable time. Should this not be possible, or prove excessively burdensome for 3V Wallcoverings Srls, the Consumer will have the right to terminate the Contract of Sale and, consequently, to obtain a refund of the sums paid for the purchase and shipment of the Product, with the exclusion of any further responsibility of 3V Wallcoverings Srls, in any capacity and for any reason.

7.5. If the Customer detects any discrepancies between what was ordered and what was received, and in particular, encounters any problem concerning the physical integrity, correspondence or completeness of the products received, he must promptly inform the Customer Assistance service of 3V Wallcoverings Srls.

7.6. Customer assistance will provide the necessary information to solve the problem, and where possible, to ship the missing items, replace the defective items or refund them.

7.7. In no event will the Customer be required to return defective items or items received in error at their own expense.

8) Communications and Complaints

8.1. All communications or any complaints against 3V Wallcoverings Srls must be addressed to the Customer Assistance Service, by filling in the appropriate form on the Contacts page.

8.2. Alternatively, the Customer can send a letter addressed to ‘3V Wallcoverings Srls – Via S. D’Acquisto, 16 – 71045 Orta Nova (FG)’

9) Intellectual property rights

9.1. The Customer declares and acknowledges that any photos of scenarios and landscapes on display are the property of the respective copyright holders; Third-party brands, product names, trade names, corporate and company names mentioned may be trademarks of their respective owners or registered trademarks of other companies and belong to their legitimate owners.

9.2. 3V Wallcoverings Srls is not liable for trademarks, distinctive signs and other intellectual and industrial property rights relating to the Products for sale on the Site whose owners are expressly indicated therein (hereinafter, the rights referred to in this article 10.2. and in previous art. 10.1., together, “Intellectual or Industrial Property Rights” ).

9.3. Any use of Intellectual or Industrial Property rights in any way and/or form, in whole and/or in part without the prior written authorization of 3V Wallcoverings Srls or its licensors is prohibited.

10) Privacy

11) Reference legislation – Jurisdiction

11.1. These General Conditions are governed and interpreted according to Italian law; likewise, any Special Conditions and each Contract of Sale will be governed and interpreted according to Italian law.

11.2. Any dispute relating to the General Conditions, the Special Conditions or the Sales Contracts will be devolved to the exclusive jurisdiction of the Court of Foggia, without prejudice to the applicability of the mandatory provisions of the law aimed at protecting Consumers.
